Badinter principle useful mechanism but only in political institutions, says Constitutional Court President

In any other place, it would create anomalies, said Constitutional Court President Darko Kostadinovski on Friday.
Referring to DUI's proposals for introduction of the Badinter principle in the Constitutional Court, Kostadinovski said the institution should not be brought into a situation of хавинг ethnic, and not legal and constitutional arguments, be crucial when taking decisions.
"If this happens, there is no need to have this institution, and citizens can forget about a legal state. The same goes for other institutions, for example the Badinter in the Judicial Council. Тhis is my personal opinion," said Kostadinovski.
Asked on the frequent voting along ethnic lines in the Constitutional Court, he said this speaks more about the judges themselves, because when a judge puts on the robe, all differences are put aside - ethnic, social, religious or societal.
"Our sole duty is to protect the Constitution and use constitutionally sound arguments. Full stop," noted Kostadinovski.
The Badinter principle is a legislative mechanism ensuring laws affecting ethnic communities pass in Parliament with a double majority, namely a simple majority of MPs and a majority of votes from lawmakers representing non-majority communities.
