SSM brings claim to Judicial Council seeking dismissal of Supreme Court judges who ruled to seize its headquarters

Skopje, 9 February 2024 (MIA) – The Federation of Trade Unions of Macedonia (SSM) has brought a claim to the Judicial Council seeking responsibility of the three Supreme Court judges who ruled to seize the building which houses the headquarters of the Federation. 

 

SSM leader Slobodan Trendafilov said Friday that the Federation seeks dismissal of judges Shpend Devaja, Nakje Georgiev and Isamedin Limani. 

 

According to Trendafilov, the judges have taken advantage of the position of the Supreme Court in the judicial hierarchy, against whose decision there is no effective legal remedy in the national legal order.

 

"We are here today in front of the Judicial Council to bring a claim seeking responsibility of the three judges. By ruling to seize and confiscate the workers' building, Nakje, Shpend and Isamedin, who do not even deserve to be called judges, deliberately and unjustifiably made a gross and unprofessional mistake that has serious consequences, which is why they are not worthy of further exercising the position of judge," said Trendafilov.

 

He sent a message to the Ombudsman to refrain from taking any steps against the workers and the Federation of Trade Unions of Macedonia, because, he noted, there still are legal mechanisms in the state, as well as before international organizations.

 

The Judicial Council announced last week that it is closely following reactions in the public, regarding the decision of the Supreme Court, which refers to the Federation of Trade Unions of Macedonia, and within the framework of its competences, it is taking actions towards establishing the situation.

 

The Supreme Court of the Republic of North Macedonia announced that on November 9, 2023, it ruled in favor of the Republic of North Macedonia, the plaintiff in a case launched against the Federation of Trade Unions of Macedonia (SSM), as the defendant, regarding ownership of the headquarters of SSM. With the announcement, the Court confirmed that it has ruled to seize the building which houses the headquarters of the Federation.
