Samka Ibraimoski says he hasn't threatened anyone, asks why Constitutional Court reconsiders its own decision

Tetovo, 25 June 2024 (MIA) - Party for Full Emancipation of Roma (PCER) leader Samka Ibraimoski held a press conference on Tuesday over actions of the Constitutional Court, which a few days ago launched a new procedure on Article 2 and Article 4 of the Law on Amendments to the Law on Obligations.
According to Ibraimoski, the main problem and the question that the public should ask is how it is possible for the Constitutional Court to first reject motion on reviewing the legality and constitutionality of the amendments to the Law on Obligations, and then reconsider its own decision again with the same motion.
"The biggest farce in this game of the Constitutional Court is that when it first rejected the motion, it was explained in detail and clarified why it was rejected, i.e. it was stated that the law refers to proceedings that are ongoing and not completed, and under such a legal solution, there is neither discrimination nor violation of the constitutional principles. This was also confirmed by the Venice Commission. Now again, under the same circumstances, the Constitutional Court is reconsidering its own decision. Will such behaviour of the highest court in the country, i.e. the court that is the guardian of the Constitution, and thus of the supreme values of a society, result in the citizens feeling legal security, or will legal confusion be created? Does this kind of behaviour put the Constitutional Court in the position of an Assembly, in the position of a Government, and does this mean that the court's strategies change with the change of constitutional judges, and laws will be changing as a result, etc.," Ibraimoski said.
According to him, the Constitutional Court should take into account the situation the people are in, and not the situation of specific interest groups.
"All my reactions this past period are precisely because of rumours that the big business and banking oligarchs are exerting pressure for these changes not to take place, because they directly affect their interest, at the expense of the citizens. Only the voice of the people should be a warning to all the institutions, including the Constitutional Court, that they are here for the people, and that is precisely why I voice my opinion loudly and publicly this time on this topic," said Ibraimoski.
In response to a reporter's question on whether it was true that he has threatened Constitutional Court judges, as some media outlets reported, Ibraimoski said he was called to the police, but it was for a question asked on the social network Facebook and he has not threatened anyone.
"I only asked one question - what if murders happen? I have conveyed the voice of the people, what they write to me, in my inbox, where they say: "I will get a gun" and "I will kill someone" or "I will kill myself". That is my one question, who will be responsible for the murders if they were to happen, I have not threatened the judges. I personally have neither threatened Ana Pavlova Daneva nor the president of the court. The president of the court voted in the first composition, when the decision was made on this law. Now in the second re-vote he voted against his independent decision. Whether something is wrong and whether there are indications is something the public prosecutor should deal with, because this law is salvation for the people, and it has not been respected for a year now, there are final judgments that are not respected by the enforcement agents. This is one big game between the enforcement agents, the oligarchs, the judges," said Ibraimoski.
The 2023 amendments to the Law on Obligations regulate the amount of penal interest and the amount of costs that people have to pay for delay in repayment, regarding which Ibraimoski said it was the end of huge interest rates.
