Skopje, 8 November 2023 (MIA) – In answer to a journalist’s question over the expiration of the statute of limitations on certain cases due to the amendments of the Criminal Code, Chief Public Prosecutor Ljubomir Joveski said Wednesday that prosecutors and judges are obliged to enforce the law, even though there are laws which they disagree with, and, he said, they will adopt the appropriate decisions whenever it is determined that the statute of limitations has expired.

“My personal feelings [on the Law] are one thing, and the implementation of the Law is another thing. Both the prosecutors and judges have a duty to enforce the Law. In this specific case, wherever it is determined that the statute of limitations has expired, the Prosecution and the courts will adopt the appropriate decisions. The prosecutors and judges have many laws which they disagree with, but they simply must respect them. This is the case here too, regardless of what we as prosecutors personally believe or think about certain legislation, we are obliged to respect them and make decisions based on them,” said Joveski. 

Parliament is yet to publish a call for a new chief public prosecutor, despite the fact that Joveski is nearing the end of his term. On this issue, Joveski said he has notified the Government about the expiration of his term.

“If a new public prosecutor isn’t selected by December 25, in line with the law, the Council of Public Prosecutors will appoint an acting prosecutor,” said Joveski.
