DUI-led European Front files interpellation motion against Constitutional Court president  

Skopje, 4 June 2025 (MIA) - MPs of the DUI-led European Front submitted Tuesday to Parliament Speaker Afrim Gashi a motion for the interpellation of the President of the Constitutional Court, Darko Kostadinovski.

At a press conference Wednesday, MP Ilir Hasani said the motion has been filed based on article 72, paragraph 1 and paragraph 2 of the Constitution of the Republic of North Macedonia. According to Hasani, Kostadinovski knowingly violated the Law on the Use of Languages and Article 101 of the Law on Constitutional Court.

“I want to stress that this initiative does not aim to exert pressure on the Constitutional Court unlike other previous interpellations which were clearly of a political nature. Instead, this motion has a social and media impact. Our goal is to launch an institutional debate over the functioning of this institution and the role of its president in complying with the Constitution and the existing laws,” Hasani said.

According to the European Front MP, the Court’s president is prejudiced against the Albanian language.

“In the reasons for the interpellation we can mention an interview with the MIA news agency in August 2024, where [Kostadinovski said], I quote: ‘the policy created by that law has created a legal chaos that has resulted in political chaos, distrust and dilemmas, it is a fact that the law is being implemented and is creating problems with its implementation’. This statement raises several issues: on the basis of which article of the Constitution or a specific law is the President of the Constitutional Court allowed to describe a law as a source of political and legal chaos; and is it in the capacity of the President of the Constitutional Court to determine issues with the implementation of the law and predict a legal intervention. These statements reduce the framework of legally defined competencies and create a series of doubts about the neutrality of the Court’s president in cases which are still being assessed,” Hasani said.

The MP also pointed to a situation during which when quizzed about why the Constitutional Court’s sign is only in Macedonian, the Court’s president said this is happening due to the adoption of bad laws and noted that the Law on the Use of Languages doesn’t include the Constitutional Court.

“This statement is insulting and expresses prejudices against a Law which was adopted by Parliament and is being implemented. The statement also violates the provisions in article 101 of the Law on Constitutional Court, which forbids public expressions of opinions on cases which are being assessed within the Court,” Hasani said.

The motion, according to the MP, does not intend to dismiss the Court’s president but rather has political implications, requiring Kostadinovski to respond to their accusations, especially since the Constitutional Court session regarding the law on the use of the Albanian language is scheduled to take place soon. Hasani said he expects Kostadinovski to attend the plenary session when the motion is discussed.
