Toshkovski: Criminal Court charged MoI with supervision of house arrest but didn’t determine manner of supervision 

Skopje, 19 August 2024 (MIA) - Following the press release issued by the Skopje-based Criminal Court on Monday in which it said the responsibility for the escape of former Kosovo Liberation Army (KLA) member Blerim Ramadani from house arrest in Skopje lies with the Interior Ministry as the supervising authority, Interior Minister Panche Toshkovski said in a social media post Monday that the Court charged the Ministry with supervision of house arrest, but did not determine the manner of supervision, which, he said, is its legal obligation.

In a post on his Facebook profile Toshkovski wrote that according to the Law on Criminal Procedure “the court performs the supervision of house arrest, but it may also entrust the supervision duty to the police, at the same time determining the manner of supervision”.  

“In the house arrest decision for the individual, the Court entrusted the supervision to the Interior Ministry – the Skopje police, without determining the manner of supervision even though it is legally obliged to do so in accordance with the aforementioned provision from article 163,” Toshkovski said.

The Interior Minister said in his experience as a lawyer, he has worked with house arrest decisions which specifically state the manner in which the supervision is to be carried out by the police.

In his post, Toshkovski wrote that despite the Court’s failure to determine a manner of supervision, the Skopje police carried out checks on several occasions, with the last one on August 13, when Ramadani was present at the reported address.
