Siljanovska-Davkova: Dukovska's decisions not questioned, unlawfully elected person cannot remain in Constitutional Court

Skopje, 20 May 2025 (MIA) - The decisions of Constitutional Court judge Elizabeta Dukovska over the past couple of years should not be questioned but a person who has been elected in an unconstitutional, even unlawful way, should not remain in the Constitutional Court, said President Gordana Siljanovska-Davkova on Tuesday.

"As I have discussed with experts and colleagues, the decisions made until now should not be questioned but a person who has been elected in an unconstitutional, even unlawful way, should not remain in the Constitutional Court. What kind of contest is that where you have more candidates but someone decides that the battle is finished even before the legal one starts," President Siljanovska-Davkova told reporters.

The President added that she had criticized Dukovska's election as being contrary to the Constitution back when she had been a VMRO-DPMNE MP in the previous Parliament composition.

"I urge you to find the transcript of the session and see what I had been saying about violating the Constitution and equal opportunities for all candidates, but arguments did not pass then. The Parliament speaker agreed with the majority, our warnings were flatly rejected and now we see the result. This has an impact on the decision-making process," said Siljanovska-Davkova.

An inaccurately implemented election procedure whereby the Judicial Council failed to equally review all candidates and did not observe the requirements from the Law on Judicial council is the reason why the Administrative Court cancelled the decision over the election of Elizabeta Dukovska for Constitutional Court judge back in April 2023.

In the specific case, the Judicial Council made the decision without fully reviewing all nominated candidates. Due to lack of materials or data about the candidates, the Council members could not carry out a thorough analysis of their competences, and although the Law on the Judicial Council requires the fulfillment of concrete election criteria, they were not formally checked prior to the vote.
