Prosecutor's Office takes proceedings on three criminal charges filed by Austrian company AMMA

Skopje, 28 June 2023 (MIA) - The Basic Public Prosecutor's Offices in Gevgelija and Skopje, as well as the Higher Public Prosecutor's Office in Skopje, have taken three separate proceedings, following criminal charges filed by the Austrian company AMMA Import Export GmbH (AMMA), regarding which the Austrian Ambassador also gave warning in an open letter on Tuesday, the Public Prosecutor's Office of North Macedonia said in a press release on Wednesday. 

 

"Although the concrete case is basically a matter of a civil-legal relationship between legal entities, while their rights are ensured in appropriate court and other procedures, the criminal charges filed are dealt with extreme diligence," reads the press release. 

 

The Prosecutor's Office notes that the mentioned legal entity filed a criminal report of fraud and abuse of office with the Basic Public Prosecutor's Office in Gevgelija in 2021. 

 

"After checking all the allegations, a competent public prosecutor has established that there are no elements of the mentioned criminal acts, but elements of a civil-legal relationship regarding which the damaged party had a procedure that has been completed before the Vienna International Arbitral Centre. After the decision was appealed, the case is with the Higher Public Prosecutor's Office in Skopje," the press release reads. 

 

In the meantime, the legal entity submitted on May 26, 2023, a report to the Basic Public Prosecutor's Office in Gevgelija of - damage or privilege to creditors.

 

Also, the legal entity filed a criminal report on June 23, 2023, to the Basic Public Prosecutor's Office in Skopje against unnamed officials in the Real Estate Cadastre Agency for malpractice, forgery of an official document and computer forgery. 

 

In an open letter on Tuesday entitled "What is going to prevail? Rule of law and protection of Austrian investments in North Macedonia or criminal collusion capturing the judiciary and officers of law?", Austrian Ambassador Georg Woutsas accused the companies DENA and GLOBAL of capturing the judiciary and officers of law in the case with Austrian investment in the country by AMMA Import Export GmbH (AMMA), based in Hohenems, Austria, and called for removal of all incompetent and biased judges and prosecutors in these cases.
