Skopje, 19 October 2023 (MIA) – Setting up a parliamentary inquiry committee over the Oncology Clinic case while an active investigation is underway is inadmissible. This is normal if the investigation is closed, but during an active investigation it is obstruction, said the president of the Skopje-based Criminal Court, Ivan Dzholev.
According to Dzholev, the investigation process is being contaminated, and there is no reaction at all about it.
"This is normal if the investigation is closed and a longer period of time has passed. In such a case, yes, but during an active investigation it is obstruction. They obtain all the documentation, they interrogate, thus contaminating the investigation process and there is no reaction at all about it," Dzholev told a press briefing on Thursday.
The question that should be raised, according to the Criminal Court president, is how it is possible to conduct a parallel investigation, i.e. to interrogate the same people that are being interrogated by the prosecution.
"Then when they come to court, the defense will say this can no longer be used as evidence, citing various reasons... then come court claims, Strasbourg and so on. It's very complicated, though it may not seem so from afar," said Dzholev.
